Employee Free Choice Act

Union Certification
If a petition is filed by an employee or group of employees for the purpose of collective bargaining, the National Labor Relations Board will inspect the petition for validation. If the petition is valid and the employees have chosen an organization to represent them, the Board will not hold an election but will designate the organization to be their representative.

Collective Bargaining Agreements
The groups will meet no later than ten days after a written request is received and will make every attempt possible to resolve the differences. After 90 days of bargaining, either party may notify the Federal Mediation and Conciliation Service for mediation. If after another 30 days an agreement is not reached, an arbitration board will be established to resolve this issue.

Penalties
An employer who commits any unfair labor practice while the employees are attempting to gain representation, the employer may be subjected to a civil penalty with a maximum fine of $20,000 for each violation. S. 560 was referred to the Senate Committee on Health, Education, Labor, and Pensions.

TARP Recipient Ownership Trust Act

The Secretary of the Treasury may give management authority to a private entity under the Emergency Economic Stabilization Act, commonly known as the US financial bailout. The Secretary of the Treasury will create an LLC with all the voting, nonvoting, and common equity of the recipients of the Troubled Asset Relief Program. The President will then appoint three independent trustees for the purposes of management. These trustees will be employed, not elected, they will serve at the will of the President, and will each be paid $162,900. Keep Americans Working Act

A short-time compensation program will be developed under this bill for voluntary States, employers, and employees. This program will be available for an employee who has experienced a reduction in work hours with the possibility of a layoff. Unemployment will be paid in a prorated fashion to an employee still working. An employer may be required to pay an employee until the State obtains funding and is able to reimburse the employer.

A State agency will be required to make sure the health and retirement benefits of an employee, participating in this program, are still available. As long as a State meets the requirements set forth by the Secretary of Labor, joining this program may be possible, and grants may be given for funding. An amount deemed necessary from the Treasury of the United States is what will be used for funding.

Four years after this bill goes into effect, a report with certain information will be created by the Secretary of Labor. This report will cost will cost $1.5 million, will be submitted to Congress, and will contain specific information on this program. S. 1646 was referred to the Senate Committee on Finance.

America’s Affordable Health Choices Act – Part 8

A tax will be imposed on the modified adjusted gross income of a taxpayer for the following income: between $350,001 and $500,000 is an increase of one percent, between $500,001 and $1 million is an increase of 1.5 percent, and over $1 million is an increase of 5.4 percent.
