Anyone facing prosecution for a marijuana offense may present evidence of compliance of State law regarding medical marijuana. If the evidence shows the defendant’s use of marijuana was not primarily medical, they may face charges. Any property seized in connection with a marijuana prosecution will not be destroyed if the Attorney General is notified the defense will be presenting the affirmative for medical marijuana use. “A health insurance issuer shall not offer health insurance coverage unless the issuer demonstrates that such coverage has a medical loss ratio of at least 90 percent.” Under this bill, the term ‘medical loss ratio’ will be determined by the Secretary of Health and Human Services.
