“A health insurance issuer shall not offer health insurance coverage unless the issuer demonstrates that such coverage has a medical loss ratio of at least 90 percent.” Under this bill, the term ‘medical loss ratio’ will be determined by the Secretary of Health and Human Services. For any year the loss ratio is below 90 percent, the health insurer will provide rebates to enrollees. The amount of the rebate is to be determined by the Secretary of Health and Human Services.
